Terms & Conditions

Last updated: September 2026

These terms set out the basis on which Samuel Goodwin ("I", "me", "my"), a sole trader trading as Standout Property Photography for property marketing services and as Rated-EPCs for Energy Performance Certificate assessments, provides services to clients — typically estate and letting agents, and in some cases property owners booking directly.

Any questions about these terms can be sent directly to:

1. Scope of services

Standout Property Photography provides property marketing services including professional property photography, digital image editing, drone (aerial) photography and video, walkthrough video, floor plans and written property descriptions.

Where separately commissioned, Energy Performance Certificates (EPCs) are provided under the trading name Rated-EPCs. An EPC is a distinct, professionally regulated assessment and is treated separately from the marketing services throughout these terms.

Services are carried out following a visit to the property and are based on the work agreed with the client and what is observed during the appointment. They do not include independent verification of legal, financial, planning, construction or other material information relating to the property unless specifically agreed otherwise.

2. Photography, video and drone

Property photographs and video are captured using professional equipment and edited to provide clear, accurate and suitable marketing material. Standard editing may include adjustments to exposure, brightness, colour, contrast, perspective, cropping and other appropriate corrections.

Images and video are intended to represent the property fairly based on its condition and presentation at the time of the appointment. Photography does not constitute a building survey, structural inspection or assessment of the condition of the property, and I cannot be responsible for defects, damage or conditions which are concealed, inaccessible, or not reasonably apparent at the time of the visit. Where an area cannot reasonably be accessed or photographed, it may be omitted from the final material.

Drone photography and video is only flown when conditions allow it to be done safely and lawfully. Photography and interior shots always go ahead as planned regardless of weather — a dull sky is corrected in the edit. Where weather on the day rules out the drone specifically, that part of the shoot is simply rescheduled for the next suitable weather window at no extra cost. As drone work is exterior-only, nobody needs to be present at the property for that follow-up visit.

3. Property descriptions

Where a written property description is provided, it is offered in good faith as a time-saving aid for the agent, prepared following a physical visit and based on visible and reasonably ascertainable features observed during the appointment, for general marketing purposes.

No material information is independently verified as part of this service, including tenure, ownership, council tax, planning permissions, building regulations, guarantees, rights of way, boundaries, services and utilities, alterations, appliance condition, or other matters requiring documentary evidence or specialist investigation.

Where an item or feature is mentioned as present at the property — for example an appliance, fixture or piece of furniture — this reflects what was visible at the time of the visit only. It is not a statement that the item works, is included in the sale or letting, or isn't subject to separate negotiation between the parties; the agent and client remain responsible for confirming what is and isn't included.

The client is responsible for reviewing the completed description and ensuring it is accurate and suitable for publication before it is used.

4. Floor plans & measurements

Floor plans are prepared from measurements taken at the property with a laser measuring device, generally to the widest accessible points of each room. Bay windows and other projecting features are not included in room measurements unless specifically indicated.

Floor plans are intended to give a reasonably accurate representation of layout and room sizes for marketing purposes. They are not an architectural drawing, building survey, professional measured survey, or a guarantee of exact dimensions. Where an area is inaccessible or unsuitable for measurement, those dimensions are omitted from the floor plan rather than estimated.

The client is responsible for reviewing the completed floor plan and raising any amendments before publication.

5. Energy Performance Certificates

Where an EPC is commissioned, the assessment is carried out separately from the property's marketing photography, floor plan and description, by Samuel Goodwin trading as Rated-EPCs, in accordance with the applicable assessment methodology, accreditation requirements and relevant regulations.

An EPC is based on information and observations available at the time of assessment. Where required information or evidence is unavailable, assumptions may be made in line with the applicable methodology. The client or person providing access is responsible for making available any documentation that may assist the assessment, and for pointing out relevant alterations, improvements or extensions that may affect it.

Only an approved energy assessor can lodge domestic EPC data on the official EPC register, and lodging on that register is a legal requirement once an EPC has been produced.

6. EPC evidence & record keeping

Where an EPC is undertaken, photographs and other supporting evidence are collected to support the assessment and demonstrate compliance with accreditation and methodology requirements. This evidence — which may include photographs of the boiler, insulation, glazing, meters and other building elements — is entirely separate from the property's marketing photographs.

EPC evidence and assessment records are retained for 15 years, in line with my accreditation scheme's audit requirements, and may be shared with my accreditation body, Elmhurst Energy, or an authorised auditor or regulator, for assessment, quality assurance or compliance purposes.

EPC evidence photographs are not supplied to the agent as marketing images and are not covered by the marketing licence described in clause 8.

7. Client review & approval

All completed photographs, video, floor plans and written descriptions are provided to the client for review before publication. The client is responsible for checking the material — including property details, room names, measurements, layout and features — and raising any inaccuracies or amendments before it goes live.

The client remains responsible for ensuring the final property particulars comply with any legal, regulatory or industry requirements applicable to marketing the property. Once the client has approved, used or published the material, the client accepts responsibility for its use and publication.

8. Copyright & licensing

Copyright in original photographs, video, floor plans and written material I create remains with me. Payment for the service does not transfer copyright — UK copyright law recognises the creator as first owner of commissioned work unless the parties agree otherwise in writing.

Instead, the agent or client is licensed to use the delivered images and video for anything related to marketing that specific property — portal listings, printed particulars, the agent's own website, and social media or wider promotion of the agency. There's no separate licensing fee or extra permission needed for this use, and reasonable technical alterations (resizing, cropping or reformatting for a portal's requirements) are fine.

This licence covers marketing of that property only. It does not permit reselling, redistributing or sub-licensing the material to another business, or supplying it to a third party for use on an unrelated property. If a property is later re-marketed by a different agent, the original licence does not automatically transfer to them — new media should be commissioned, or a separate written agreement reached. Any transfer or assignment of copyright must be agreed separately in writing.

9. Portfolio & promotional use

Unless a client asks otherwise in writing, Standout Property Photography may retain and use completed marketing photographs, video, floor plans and descriptions for its own portfolio and promotional purposes — including on the Standout Property Photography website, social media and marketing material.

EPC evidence photographs and other confidential assessment records are never used for portfolio or promotional purposes.

10. Access, condition & safety

The client is responsible for providing suitable access to the property at the agreed appointment time, including any keys, access codes or alarm instructions reasonably required. Where access to a room, garden, garage or other area isn't possible at the time of the appointment, that area may simply be left out of the finished material. Any keys provided are kept securely while in my possession and returned as arranged with the client.

The property should be reasonably safe and accessible to photograph, measure and assess. I reserve the right not to enter, photograph, measure or assess an area that appears unsafe, inaccessible or unsuitable, and I'm not responsible for defects or hazards that are concealed or not reasonably apparent during the visit.

11. Amendments & additional visits

Reasonable corrections relating to an error in the material I've produced are included as part of the service. Requests for substantial rewrites, significant floor plan changes, additional photography, or a return visit for reasons outside an error on my part, may be subject to an additional charge — as may work needed because the property has materially changed since the original appointment, or new information comes to light afterwards.

12. Cancellations & access delays

I try to stay flexible around cancellations, since it's rarely the agent's fault if a client cancels last minute. Letting me know the day before is no issue at all. Cancellations on the day, or after I've already set off, are handled at my discretion — usually resolved by simply rescheduling rather than a charge.

Where a property genuinely can't be accessed at the agreed time for reasons within the client's control, a return visit may be subject to an additional charge. Where delays or additional visits arise from circumstances outside my reasonable control, any further arrangements will be discussed with the client directly.

13. Pricing & coverage area

Pricing is confirmed at the time of booking and is set out on the current price list or quote provided to the client — it is not fixed by these terms and may be updated from time to time. Pricing doesn't vary by property size; the only factor is location, with travel time added for properties outside the core coverage area.

The core coverage area — HU17 (Beverley), HU18 (Hornsea), HU11 (East Hull villages), HU7 (Kingswood), HU12 (Hedon) and HU19 (Withernsea) — is covered at standard pricing. Any other HU postcode is also covered, quoted on request. I'm not VAT registered, so no VAT is added on top of quoted prices.

Where an EPC is booked directly with a homeowner or independently of an agent instruction, pricing may be agreed separately and confirmed at the time of booking.

14. Accuracy & limitation of responsibility

Reasonable care is taken in preparing all photography, video, floor plans, descriptions and EPC assessments. However, the marketing service is based primarily on visual observation and physical measurement during the property visit, and doesn't include independent investigation of matters that can't reasonably be established through visual inspection.

I can't accept responsibility for inaccuracies or omissions arising from: information that wasn't visible or reasonably ascertainable during the appointment; concealed defects; information later supplied or altered by the client; inaccurate information provided by the client or another party; areas that couldn't reasonably be accessed or measured; changes to the property after the appointment; or a failure to review and approve material before publication.

Once media has been supplied, I'm not responsible for alterations, compression or formatting changes made by third-party portals or platforms, or for how the client or a third party subsequently uses the material. Nothing in these terms excludes or limits any liability which cannot legally be excluded or limited.

15. Client responsibility

The client is responsible for checking and approving all completed material before publication, and for ensuring the final property particulars — photographs, floor plan, description and any other marketing information — are accurate, complete and suitable for publication. These services do not replace a client's own legal, regulatory or professional responsibilities as an estate agent, letting agent, or property owner marketing the property.

16. Agreement to these terms

By booking or commissioning services from Standout Property Photography — whether by email, telephone, message, the website enquiry form, or other written or verbal instruction — the client confirms they've had the opportunity to read these terms and agrees the service will be provided on this basis, unless otherwise agreed in writing. Any variation to these terms must be agreed in writing.

Important note

These terms are intended to clearly set out the scope of the services provided and the responsibilities of each party. They're not a substitute for independent legal or professional indemnity advice, and don't override any statutory or regulatory obligation applicable to either party. If you'd like a copy for your own records, or have any questions before booking, just get in touch.
